The landscape for municipal employers is shifting as Colorado enacts the Protections for Public Workers Act (PROPWA), a new law granting broad rights to public employees to associate, discuss workplace matters, and engage in expressive and concerted activities. For cities and towns, this represents uncharted territory, since municipalities have historically been excluded from most national and state labor laws.

This Knowledge Now explores what PROPWA means for Colorado municipalities. Authored by Taylor McGaughey, law clerk at Dufford Waldeck and former CML law clerk, the paper outlines the scope of employee protections, the challenges of interpreting PROPWA’s broad and sometimes undefined language, and the potential conflicts with home rule authority. It also examines how municipalities should evaluate training, policies, and compliance in light of the new law and forthcoming regulations from the Colorado Department of Labor and Employment.
