WHAT DOES THE BILL DO?
Senate Bill 26-098, State & Local Noise Abatement Authority, allows local governments to enact reasonable noise ordinances without cumbersome and antiquated state rules. The bill clarifies local authority to ensure that municipalities and counties can develop noise permitting programs that fit their communities and support vibrant neighborhoods and economic districts.WHY YOU SHOULD VOTE YES
Municipalities have traditionally regulated noise, including amplified sound from special events and venues. Through special permits and licensing, municipalities responsibly balance any impacts of noise with community needs and desires, including by permitting the use of amplified sound at higher limits on public and private property through cultural, entertainment, athletic, and patriotic events. Local noise regulations focus on public safety and ensuring quality of life.
Last year, the Colorado Supreme Court, in Hobbs v. City of Salida, limited government entities from determining the sound levels that are right for their localities and contexts simply because an event would occur on private property. This includes all events, including Colorado’s premier music venues, destination music festivals, cherished community events, and your favorite bar, restaurant, or coffee shop. The Hobbs decision undermines longstanding practices and the viability of music venues, restaurants and bars, and festivals that build local economies and define local identities.
