2017 Attorney General Memo Regarding Sanctuary Cities and Grants

May 22, 2017

The Office of the Attorney General released a memorandum for all department grant-making components regarding Executive Order 13768: Enhancing Public Safety in the Interior of the United States. The memo addresses the term “sanctuary jurisdiction,” defining it as jurisdictions that “willfully refuse to comply with 8 U.S.C. 1373.” It also reserves the right for the Department of Homeland Security to “point out ways that the state and local jurisdictions are undermining our lawful system of immigration or to take enforcement action where state or local practices violate federal laws, regulations, or grant conditions.”
